These Terms & Conditions (“Terms”) govern your access to and use of Focial’s websites, applications, and services (the “Services”). By using the Services, you agree to these Terms.

The Services

Focial provides a multi-brand social workspace for publishing, scheduling, analytics, media management, and team collaboration. Features may change over time as we improve the product.

Accounts

You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. You must provide accurate information and promptly update it when it changes. You must be legally able to enter into these Terms in your jurisdiction.

Acceptable use

You agree not to:

• Use the Services for unlawful, harmful, or deceptive activity
• Violate platform policies of networks you connect (e.g. Instagram, Meta, X)
• Attempt to gain unauthorized access to systems or other users’ data
• Interfere with or disrupt the Services or related infrastructure
• Reverse engineer or misuse the Services except as allowed by law

Your content

You retain ownership of content you submit. You grant Focial a limited license to host, process, and transmit that content solely to operate the Services you request (including publishing to connected platforms). You represent that you have the rights needed to use and share that content.

Third-party platforms

Connected social networks are independent services. Their terms and availability apply separately. Focial is not responsible for changes, outages, or policy enforcement by those platforms.

Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation.

Limitation of liability

To the maximum extent permitted by law, Focial and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Services.

Termination

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the Services. For account deletion, email info@focial.one or see Delete Data.

Changes

We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
